• We collect only what we need to answer you and do your project.

• We share it only with the service providers listed below, which run this site and our business.

• Contact and quote forms: your name, email, phone (if given), business name, website, budget, timeline, and project details.

• Website Analyzer: the public web address you enter. We fetch only that public page.

• JoeBot chat: JoeBot runs on pre-written answers built into this website. It does not send your messages to any outside AI service.

• Hosting logs: When you visit, our host (Vercel) automatically records technical data such as IP address, browser type, and pages requested. These logs are used for security and performance.

• Client work: project files, invoices, and any account access you give us. We ask clients to add us as a user instead of sharing passwords (see Section 5).

• Payments: Payments are handled by a third-party payment processor. We never see or store full card numbers.

• Site analytics: We may use Vercel Web Analytics, a feature of our host, to see visit counts in aggregate, such as pages viewed, the site that referred you, your general location (country), and your device and browser type. It does not use cookies, and we use it only to understand how the site is used and to improve it.

• In-browser features: Some interactive features, such as on-page prompts and JoeBot, respond to how you use the page (for example, scrolling or leaving the page) and may keep a short note, such as your JoeBot messages, in your browser's session storage. That stays in your browser, is cleared when you close the tab, and is not sent to us.

• What we don't do: We do not use Google Analytics, advertising cookies, or tracking pixels, and we do not sell your browsing data or use it for advertising. If that ever changes, we will update this policy first.

We use your information to:

• reply to you;

• prepare quotes;

• deliver and support your project;

• send invoices and keep tax records;

• keep this site secure;

• meet legal obligations.

We never sell, rent, or trade your information. We share it only with:

• Web3Forms, which delivers our website form submissions to our email;

• Vercel, which hosts this website;

• Titan (Titan Email), for our business email, and Google (Drive), for file storage;

• our payment processor, for payments, once in use;

• authorities, when the law requires it.

If the business is ever sold, your information may transfer to the new owner under this policy.

We ask you to add Joe Web Works as a user or manager on your domain, hosting, Google, and other accounts. Do not send us your passwords. If an account cannot add users, we will help you set up a temporary login and ask you to change it after handoff. We remove our access when the project ends, or sooner if you ask.

• Inquiries that don't become projects: deleted after 12 months.

• Project and tax records: kept for 7 years, then deleted.

• Hosting logs: kept for the host's standard log period.

We follow a Written Information Security Program under Massachusetts rules (201 CMR 17.00). Measures include:

• secure, encrypted connections (HTTPS);

• unique passwords and 2-step verification on our accounts;

• encrypted devices;

• giving access only to people who need it.

If a breach involves your personal information, we will notify you, the Massachusetts Attorney General, and the Office of Consumer Affairs and Business Regulation as required by M.G.L. c. 93H.

• Emails: We email you about your inquiry or project. Any marketing email will include a valid postal address as required by law and an unsubscribe link (CAN-SPAM).

• Texts: We text only people who ask us to. Reply STOP to opt out at any time.

Our services are for businesses. We do not knowingly collect information from children under 13.

You may ask to see, correct, or delete your information, or to stop marketing emails. Email jhernandez@joewebworks.com and we will respond within 30 days. Some records must be kept for tax purposes.

We will post any changes here with a new effective date.

"Joe Web Works," "we," and "us" mean Jose Hernandez, doing business as Joe Web Works. "You" or "Client" means the business or person buying services. These Terms apply when you sign or click to accept a written quote or Statement of Work ("SOW"), or sign up for a monthly plan. Browsing this website does not create a contract. If these Terms and your SOW conflict, the SOW controls for that project.

We provide website design and development, redesigns, e-commerce, SEO, Google Business Profile setup and optimization, and ongoing care plans. Your SOW lists the deliverables, the number of pages and revision rounds, the timeline, and the total flat price. Anything not listed in the SOW is out of scope.

(a) Flat-rate packages. Projects are priced at a flat rate per package. The website shows price ranges (Launch $1,500–$2,500; Growth $3,500–$5,000; Dominate $8,000–$15,000). Before you pay anything, you get a written quote with the total price and exactly what is included. No work starts and nothing is charged until you approve that quote.

(b) Not included unless listed: hosting, domain registration, paid plugins, stock photos, and third-party subscriptions. You pay these directly to the provider.

(c) Out-of-scope work is billed at $250 per hour. We will give you a written estimate (email is fine) and get your written approval before any out-of-scope work starts. We will not bill for out-of-scope work you did not approve.

(a) Deposit: 50% of the project price is due when you accept the SOW. It reserves your place in our schedule.

(b) Final payment: the remaining 50% is due at Delivery (see Section 7).

(c) No card surcharge: We do not add a surcharge for paying by credit card (M.G.L. c. 140D, § 28A).

(d) Late payments: We send a reminder when an invoice is due. Invoices unpaid 30 days after the reminder may be charged a late fee of 1.5% per month on the unpaid balance. We may pause new work while an invoice is unpaid, but we will never take down a live site or remove your access to your own accounts.

(e) Billing problems: Please contact us first so we can fix any billing issue before you file a chargeback.

(f) Taxes: Fees do not include any sales tax that may apply.

(a) Before work begins: If you cancel before we start work, you get a full refund of your deposit. Work "begins" when we send you the first discovery questionnaire, wireframe, or design draft.

(b) After design starts, before Delivery: 50% of the deposit (that is, 25% of the project price) is refundable. We keep the other half for the design work already done. If you have also paid any amount beyond the deposit, that amount is refunded too.

(c) After Delivery: No refund. By then the work has been delivered and approved.

(d) If we cancel or fail to deliver: If we cancel the project, or we miss the agreed SOW deliverables and do not fix the problem within 10 business days of your written notice, you get a full refund of everything paid for work not delivered. That refund applies no matter which stage the project is in.

(e) Refunds are sent to your original payment method within 14 days.

(a) Timelines on our website are typical, and they start once we have your deposit and all your content (text, logo, photos, and account access).

(b) Your content deadline: Please give us content and feedback within 5 business days of each request. If something is more than 10 business days late, the timeline moves and we may reschedule. If a project is paused more than 30 days waiting on you, we may close it. In that case the refund rules in Section 5 apply.

(c) Revisions: Your package includes the number of revision rounds listed in your SOW (Launch: 2; Growth: 3; Dominate: 3). A round is one consolidated list of changes. Extra rounds are out-of-scope work under Section 3(c), quoted and approved in writing first.

"Delivery" happens when we give you the finished site (or deliverable) and one of these occurs:

(i) you approve it in writing (email or text is fine), or

(ii) the site goes live at your direction, or

(iii) 10 business days pass after we send it to you and you have not sent us a written list of items that don't match the SOW.

If you send such a list, we fix those items and the 10 days start again. We never launch without your approval.

(a) Once you have paid in full, you own your website's design, the custom code we write for you, and your content.

(b) Your accounts are yours: your domain, hosting, Google Business Profile, and other accounts are registered in your name from the start.

(c) We keep ownership of our pre-existing tools, code libraries, and templates. You get a permanent, non-exclusive license to use them as part of your site.

(d) Open-source and third-party components are covered by their own licenses.

(e) No hostage: We will never hold your domain, accounts, files, or live site hostage.

(f) Portfolio: We may show completed work in our portfolio unless you tell us in writing not to.

Please give us access by adding Joe Web Works as a user or manager on your domain, hosting, Google, and other accounts. Do not send us your passwords. If an account cannot add users, we will help you set up a temporary login and ask you to change it after handoff. You may remove our access at any time after the project ends.

You agree to:

• provide content, approvals, and account access on time (Sections 6 and 9);

• make sure you own or have permission to use all content, photos, logos, and claims you give us;

• name one contact person who can approve work.

(a) Price and renewal: The Care Plan costs $149.95 per month. It renews automatically each month until you cancel.

(b) Your consent: Before your first charge, you will check a box (unchecked by default) that confirms you agree to the monthly price, to automatic renewal, and to our keeping your card on file with our payment processor to charge each month. We email you a confirmation with these terms and how to cancel.

(c) How to cancel: You can cancel at any time using any of these:

• email jhernandez@joewebworks.com;

• use the cancel link in your billing receipt or customer portal;

You don't need to give a reason, and there is no cancellation fee.

(d) When it takes effect: If we receive your cancellation before your next billing date, you won't be charged again. Your plan stays active until the end of the month you already paid for. We confirm cancellation in writing.

(e) Price changes: We give you at least 30 days' written notice before any price change. You may cancel before the new price applies.

(f) What's included is listed on our website and in your sign-up confirmation. Monitoring and backups are provided only as described there.

Hosting, domains, Google, plugins, and payment services are run by other companies under their own terms. We are not responsible for their outages, policy changes, or pricing. We are not affiliated with or endorsed by Google.

(a) Workmanship: We will perform the work in a professional, workmanlike manner. We will fix any defect in our own code that you report within 30 days after Delivery, at no charge.

(b) No guaranteed results: We do not guarantee search rankings, Google placement, traffic, conversions, leads, or revenue. Any examples are illustrations, not promises.

(c) AI-assisted work: We may use AI-assisted tools for drafting. We review that work before delivery, and you approve final content before it goes live.

(d) Except for the promises in this Section, services are provided as-is, to the extent the law allows.

(a) Neither party is liable for lost profits or indirect, incidental, or consequential damages.

(b) Our total liability is limited to the greater of (i) the fees you paid us in the 12 months before the claim or (ii) the total fee for the service that gave rise to the claim.

(c) These limits do not apply to fraud, gross negligence, willful misconduct, or claims that cannot be limited under M.G.L. c. 93A or other law.

(a) You will cover us against third-party claims that content, photos, logos, or claims you supplied infringe someone's rights or are unlawful.

(b) We will cover you against third-party claims that the original code or design we created (not your content or third-party components) infringes someone's copyright.

Each of us will keep the other's non-public information confidential and use it only for the project. This lasts for 3 years after the project ends, and for account access and personal information it lasts as long as we hold them.

Either party may end a project with written notice. If you end it, the refund rules in Section 5(a)–(c) apply. If we end it without cause, Section 5(d) applies. When a project ends, we hand over all completed, paid-for work and remove our access to your accounts.

Joe Web Works is an independent contractor. Nothing in these Terms creates an employment, partnership, or agency relationship. Jose Hernandez performs the work. Any helper he occasionally uses is bound by confidentiality.

You agree that electronic signatures, click-to-accept, and email approvals are valid and binding (M.G.L. c. 110G; 15 U.S.C. § 7001). Whoever accepts confirms that they are authorized to do so for the Client.

If we give you a translation of these Terms, the English version controls. / Si recibe una traducción de estos Términos, la versión en inglés prevalece.

(a) These Terms are governed by Massachusetts law.

(b) We will first try in good faith to resolve any dispute for 30 days. Either of us may then propose non-binding mediation.

(c) If the dispute is not resolved, either party may bring a claim in the state courts sitting in Middlesex County, Massachusetts, including small claims.

(d) Nothing here limits rights under M.G.L. c. 93A.

(a) Force majeure: Neither party is responsible for delays caused by events beyond its reasonable control.

(b) Changes to these Terms: We may update these Terms for future work by posting a new effective date. Changes do not affect a signed SOW or an active plan unless you agree in writing. For Care Plan prices, Section 11(e) applies.

(c) Copyright notices: Send copyright (DMCA) notices to jhernandez@joewebworks.com.

(d) Severability: If any part of these Terms is unenforceable, the rest still applies.
